Fender have only demonstrated to the court that they would own the copyright if Leo Fender and employees of the Fender company were the sole creators of the copyright work. A lot of outside people contributed to the design with no idea that a valuable copyright might be created, so the assumption that the Fender company was the sole owner may be false. Certainly no explicit assignments of copyright by non employees as required by law will have been made.

The court was satisfied that Leo Fender was the author of the work and that FMIC is the owner of the exclusive right of use.
